Interim or Outsourced Assignments

Health care companies may need to fill general/in-house legal counsel or compliance/privacy officer positions due to a recent or sudden departure, an over-extended team or a special project. After an internal assessment, some small and mid-sized companies may decide to outsource their entire legal and/or compliance functions or designate outside counsel to manage these functions. Some start-up and other companies do not have the need for, or cannot afford, a full-time general counsel or compliance/privacy officer and desire the cost-effectiveness and flexibility of a dedicated and experienced outside counsel/officer. In any of these circumstances, engaging an outside counsel may be the best, forward-looking approach by a health care company for a transitional period or a long term solution.

Lew Lefko can serve as in-house or general counsel, chief compliance officer or privacy officer on a dedicated, designated, interim, temporary or outsourced basis for your health care company. Lew has the skills, experience and proven leadership for in-house/general counsel and/or compliance/privacy officer assignments. Lew has worked with many executive management teams and brings integrity, independence, attention, diligence, confidentiality and objectivity to such work.

For in-house/general counsel assignments or appointments, Lew provides day-to-day general legal and health care industry-specific advice and counsel, performs legal duties associated with corporate governance, negotiates and manages business/commercial contracts and addresses labor and employment issues. All of these services can be arranged on a flexible time basis at a fixed weekly or monthly fee. Non-routine matters, such as a merger or acquisition, are excluded from standard in-house/general counsel assignments but may be arranged on a fixed fee, hourly rate or alternative fee basis.

For compliance and/or privacy officer assignments or appointments, Lew assists the health care company develop, implement, manage and maintain the compliance program and its components. Lew provides overall direction, conducts the risk assessment, drafts compliance/privacy policies and procedures, works with the company’s IT/records staff to develop a health information security plan, oversees audit and monitoring activities, provides regulatory updates to the executive team, coordinates training, evaluates the program and reports to corporate officers and directors.

All of these services can be arranged on a flexible time basis at a fixed weekly or monthly fee. Non-routine compliance matters, such as internal investigations of fraud/abuse or privacy or security breaches and their remediation, are excluded from standard compliance/privacy officer assignments but may be arranged on a fixed fee, hourly rate or alternative fee base reimbursement concerns.
